Terms of Sale

Article 1 - Purpose

These Terms of Sale (hereinafter "Terms") define the contractual conditions applicable to subscribing to the Lumy service (hereinafter "the Service"), published by Robin Le Corre (hereinafter "the Publisher"). These Terms of Sale complement the Terms of Use of the Service. In case of conflict, the Terms of Sale shall prevail for provisions relating to subscriptions.

Article 2 - Offer Description

The Service and subscriptions are intended exclusively for users residing in France. The Publisher offers monthly or yearly subscriptions providing access to all Service features: - Unlimited asset and loan tracking - Net worth visualization and projections - Data export - End-to-end encryption of financial data A 14-day free trial is offered to all new users. During this period, users have full access to the Service with no commitment.

Article 3 - Price

The subscription prices are: - Monthly: 3€ including all taxes per month - Yearly: 30€ including all taxes per year The Publisher reserves the right to modify pricing at any time. Any price change will be notified to the Subscriber by email at least 30 days before taking effect. The Subscriber may then cancel their subscription before the new rate applies. Prices are indicated in euros and include all applicable taxes.

Article 4 - Payment Methods

Payment is made by credit card through the secure Stripe platform. Accepted payment methods are: Visa, Mastercard, American Express. The Publisher does not store any banking data. All transactions are processed by Stripe, a PCI-DSS certified provider. Payment is due immediately upon subscription, then recurrently on each anniversary date of the subscription (monthly or yearly depending on the chosen plan).

Article 5 - Trial Period

All new users benefit from a 14-day free trial period starting from account creation. During this period, users have access to all Service features. At the end of the trial period, users must subscribe to a paid plan to continue using the Service. No payment is required to benefit from the trial period. Users may add a payment method at any time during or after the trial period.

Article 6 - Right of Withdrawal

In accordance with applicable consumer protection laws, the Subscriber acknowledges and accepts that Service execution begins immediately after payment validation, before the expiration of the 14-day withdrawal period. Consequently, the Subscriber expressly waives their right of withdrawal for the subscribed subscription. This waiver does not apply to the free trial period, which may be terminated at any time without charge.

Article 7 - Duration and Renewal

The subscription is taken out for a one-month or one-year period depending on the chosen plan, automatically renewable by tacit renewal. Renewal occurs automatically on each anniversary date, unless canceled by the Subscriber before that date. The Subscriber can view their next renewal date in the "Subscription" section of their account.

Article 8 - Cancellation

The Subscriber may cancel their subscription at any time from the "Subscription" section of their account. Cancellation takes effect at the end of the current subscription period. The Subscriber retains access to the Service until that date. No refund is made for the remaining period after the cancellation request. In case of serious violation of the Terms of Use or these Terms of Sale (including fraudulent use, security breaches, or illegal activity), the Publisher reserves the right to immediately suspend access to the Service and cancel the subscription after formal notice sent by email remaining without effect for 7 days. In case of cancellation due to Subscriber fault, no refund will be made for the remaining period.

Article 9 - Refunds

Given the waiver of the right of withdrawal and the nature of the Service (immediate access to a digital service), no refund is granted after the start of the paid subscription period. In case of major Service malfunction attributable to the Publisher rendering the Service completely unusable for more than 7 consecutive days, the Subscriber may request a credit corresponding to the unavailability period.

Article 10 - Legal Guarantee of Conformity

In accordance with articles L.224-25-1 et seq. of the French Consumer Code, the Service is subject to the legal guarantee of conformity. The Service is deemed conforming if it notably meets the following criteria: - It corresponds to the description, type, quantity, and quality provided for in the contract - It is fit for the purpose ordinarily expected of a service of the same type - It is provided with all accessories and instructions specified in the contract - It is updated in accordance with the contract In case of non-conformity, the Subscriber may require the Service to be brought into conformity. Conformity shall be achieved within 30 days of the Subscriber's request, unless technical complexity justifies a longer period, which shall be communicated to the Subscriber. If bringing it into conformity is impossible or does not occur within this time, the Subscriber may obtain a price reduction or contract termination under the conditions set out in articles L.224-25-20 et seq. of the French Consumer Code. This guarantee applies throughout the entire duration of the Service provision as specified in the contract. The Subscriber is informed that the guarantor of the Service's conformity is the Publisher, Robin Le Corre.

Article 11 - Invoicing

An electronic invoice is issued for each payment and sent by email to the Subscriber. The Subscriber may also view and download their invoice history through the Stripe payment portal accessible from the "Subscription" section of their account.

Article 12 - Payment Default

In case of payment failure (expired card, insufficient funds, etc.), the Publisher will retry the payment in the following days. If payment fails repeatedly, access to the Service will be suspended until regularization. The Subscriber may update their payment method from the "Subscription" section of their account. After 30 days of payment default, the Publisher reserves the right to cancel the subscription.

Article 13 - Modification of Terms

The Publisher reserves the right to modify these Terms of Sale at any time. Any modification will be notified to the Subscriber by email at least 30 days before taking effect. The Subscriber may cancel their subscription before the new conditions apply if they do not accept them. Continued use of the Service after the modifications take effect constitutes acceptance of the new Terms of Sale.

Article 14 - Applicable Law and Disputes

These Terms of Sale are governed by French law. In accordance with European regulations, in case of dispute, the Subscriber may use a consumer mediator free of charge. The list of mediators is available at: https://ec.europa.eu/consumers/odr Failing amicable resolution, French courts shall have jurisdiction over any dispute relating to the interpretation or execution of these Terms of Sale.

Article 15 - Force Majeure

Neither party shall be liable for failure to perform its obligations in the event of force majeure as defined in Article 1218 of the French Civil Code (unforeseeable, irresistible event beyond the parties' control, such as natural disasters, cyberattacks of exceptional scale, government decisions, etc.). The party invoking force majeure must notify the other party as soon as possible and take all reasonable measures to limit its effects. If the force majeure event continues for more than 90 consecutive days, either party may terminate the contract by registered letter with acknowledgment of receipt, without compensation.

Article 16 - Referral Program

The Publisher offers a referral program allowing users to invite new users to the Service. Eligibility: - The referral program is reserved exclusively for users with an active paid subscription (monthly or yearly) - Users in free trial period cannot participate in the referral program - Referrers can only refer users who subscribe to the same plan type: monthly subscribers can only refer monthly subscribers, yearly subscribers can only refer yearly subscribers Program Terms: - Each eligible user has a unique referral link accessible from their account - When a referred user subscribes to a paid plan, both the referrer and the referred user receive benefits according to the following terms: Referrer Benefits: - Monthly subscription: €1/month discount for 1 year (i.e., €2/month instead of €3/month) - Yearly subscription: €10 discount on their next yearly renewal (i.e., €20 instead of €30) Referred User Benefits: - Monthly subscription: €1/month discount for 1 year (i.e., €2/month instead of €3/month) - Yearly subscription: €10/year discount for 1 year (i.e., €20 instead of €30 for the first year) Stacking Rules: - Only one referral benefit can be active at a time per user (no stacking) - If the referrer already has an active referral benefit, they can still refer new users, but only the referred user will receive the benefit - Benefits are credited once the referred user has completed their first payment Conditions: - Referral benefits are non-transferable and cannot be exchanged for cash - The Publisher reserves the right to modify or discontinue the referral program at any time, with 30 days notice to participants - Any fraudulent use of the referral program (self-referral, fake accounts, etc.) will result in immediate cancellation of acquired benefits and may lead to account suspension - The referral program cannot be combined with other promotional offers unless explicitly stated
